1. Our Role, Booking Intermediary
Private Boat Tours Hvar is an online booking platform operated by ZenStack obrt. We act as an intermediary and are not a travel agency or tour operator. We present tours, take bookings and collect payment on behalf of an independent, licensed boat tour operator. The tour itself is provided and performed by the operator, not by the platform. Your service contract for the tour is concluded directly between you and the operator. The operator is responsible for performing the tour and for issuing the fiscal invoice (racun) for it. 2. Agreement to Terms
By using this booking platform you agree to these Terms and Conditions and our Privacy Policy. These Terms govern your use of the platform and your booking. The conduct of the tour itself is the responsibility of the operator you book.
3. Booking and Payment
Bookings are made in advance. Depending on the operator, you either pay a reservation deposit online and the remaining tour price to the operator on the day of the tour, or the full tour price online, in which case nothing further is owed on the day. Which of the two applies is stated before you confirm. The reservation deposit is part of the tour price and is counted towards it. It is not an additional charge, and it also secures your date; the cancellation terms below set out when it is retained. Online payments are processed securely through Stripe and are collected by the platform in the name and for the account of the operator. Any amount payable on the day is paid to the operator directly. The operator issues the fiscal invoice (račun) for the tour price. The price shown for each tour is the total you pay, however it is split, and no additional charges are added at checkout.
4. Cancellation Policy
The reservation deposit secures your date and is not refunded if you cancel, at any point after booking. Where the tour was paid in full, the amount corresponding to the reservation deposit is retained on the same terms and the remainder of the tour price is refunded when you cancel more than 10 days before the scheduled departure time; within 10 days of departure the tour price is not refunded either. You may cancel at any time regardless, and doing so releases the date. A change of mind is not a cancellation right. Specific stops or attractions are not guaranteed and may change for weather, sea or harbour-authority reasons; where the operator adapts the route and still provides a reasonable alternative of comparable value, the booking is considered fulfilled. Where the operator cannot provide the tour safely or lawfully at all and no reasonable alternative is possible, for example unsafe weather or sea conditions, a safety risk, vessel unavailability, or other circumstances beyond reasonable control, you are first offered an alternative date; if no alternative date can be agreed, everything you paid is refunded, including the reservation deposit. Whether such circumstances exist is determined by the operator, acting reasonably and in good faith. Uncomfortable weather is not the same as unsafe weather. Refunds are issued by the platform on the operator's behalf to your original payment method. Because this booking is for a leisure service on a specific date, the statutory 14-day right of withdrawal does not apply once the booking is confirmed; the cancellation terms above apply instead.
5. Safety Requirements
All passengers must follow the safety instructions provided by the operator's crew. Life jackets are provided and must be worn when requested.
6. Liability
The tour is provided by the operator, who is responsible for its safe performance and maintains the passenger liability insurance required by Croatian maritime law. Passengers participate at their own risk. The platform acts only as a booking intermediary and is not the carrier or service provider.
7. Eligibility
You must be at least 18 years old to make a booking. By placing a booking, you confirm that you are 18 or older and have the legal capacity to enter into a binding agreement.
8. Governing Law and Disputes
These Terms and any booking are governed by the laws of the Republic of Croatia, without prejudice to the mandatory consumer-protection rights you have under the law of your country of residence. If a dispute cannot be resolved with us directly, EU consumers may seek out-of-court resolution through a competent alternative dispute resolution (ADR) body; information on consumer redress in the EU is available at consumer-redress.ec.europa.eu.
